Nearly a decade ago, Marty Fogarty was tired of watching families stress out over legal issues related to caring for elderly family members. In this episode of Heartland Law Firm Podcast, Marty talks with host Kimberly Henrie on the topic of nursing home financial aid. They discuss what nursing home financial aid is, who is eligible for it, and what patients must do to qualify for it. If your family member does not have long term care insurance, then living on one’s own assets can be a real strain on the family budget.

Nursing Home Financial Aid Can Lower Stress

Tune in to hear Marty discuss the financial anxiety that goes along with the stress of learning that a family member suffers from a chronic illness and require from some type of long-term medical care facility, such as a nursing home. Few families can pay the $7,000 to $10,000 out-of-pocket per month for a stay in such a facility.

Heartland Law Firm works with families to help them qualify for a couple of different benefits, one of them being the Nursing Home Financial Aid Benefit, a subchapter of the Medicaid Laws. Here are the tests one must pass before receiving this kind of aid.

1. Asset Test – You qualify for the program if you have a certain need level, somewhat like applying for tuition assistance in college. There are different amounts for single or married, which Marty explains during the program, as well as some other stipulations.

2. Income Test – In this test, the applicant can keep $30 per month with the rest of his or her income going to the nursing home for his or her care. Financial aid pays anything over that amount to make up the difference.

3. Look-back Test – Medicaid looks at your records for the past 5 years to see what types of things might shrink someone’s estate. Marty relates that he has had clients who tried to shrink their estates through gift-giving, and that he has had to help them un-give the gifts because of it.
