  • Understanding the POLST Process

26 NOV 2013 · Marty Fogarty founded the Heartland Law Firm nearly a decade ago, and he sees firsthand the difficulty of moving between life’s transitions. The Heartland Law Firm is dedicated to helping families plan ahead so no one has to go through these transitions alone. Even if you are not dealing with a legal issue right now, the Heartland Law Firm Podcast has tips that may come in handy at some future point in your life. Tune in to this episode where Marty interviews professional Geriatric Care Manager, Noreen Coussens about the new POLST Process in Illinois. Answering Questions about POLST Issued by the Illinois Department of Public Health, the POLST Process replaces traditional DNR (Do Not Resuscitate) and advanced directive forms for seriously ill patients, allowing them to choose the treatments they want and ensure that their wishes are honored. POLST stands for Physicians Orders for Life Sustaining Treatment. Marty has a lot of questions about the new policy, and Noreen is happy to answer them all, providing a wealth of information. Some of the questions she answers cover topics that include: - Primary differences between POLST, traditional DNR, and Power of Attorney - How the form carries out dignity for the patient in regards to end of life planning - Which medical interventions are covered on the form, i.e. comfort measures Moving right along, Marty and Noreen go on to discuss the effect of POLST on a person’s passing from life. Without naming names or giving up private details, she uses the example of an elderly person with an only child. You will not want to miss hearing how different their situation could have turned out if her wishes had been honored. When Should You Have a POLST? Do you need a POLST? Noreen also tackles this question, giving facts about the people for which the process was intended. However she also describes which type of people are better covered by Power of Attorney. Maty and Noreen wrap up the episode by talking about how Illinois residents can get a POLST put into place - including how to bring up the topic with family. If you have more questions for Noreen about this way of honoring a patient’s last wishes, then you can contact her at nbcoussens@gmail.com or 224-567-3974. As a lawyer he sees firsthand the difficulty of moving between life’s transitions and feels families shouldn’t have to stress by going through them alone. Therefore the Heartland Law Firm is dedicated to helping families plan ahead to avoid a future path that avoids stress. Even if you are not dealing with a legal issue right now, the Heartland Law Firm Podcast has tips that may come in handy at some future point in your life. Tune in to this episode where Marty discusses the topic of probate with host Kimberly Henrie. After you listen you can head over to www.heartlandlawfirm.com to learn more or ask any specific questions you have. Having a Will Alone Is Not Enough As Marty points out during the podcast, when you pass away the question is, “Who owns your stuff when you are no longer here?” The probate court is a public route that will take the necessary steps to answer that question. A will is a letter to the probate court that tells the judge where you want your stuff to go, and asks the judge to appoint an executor, who then: - Changes a deed - Transfers bank funds - Handles anything else in the will However going through probate causes more harm than good, especially financially. But during the podcast Marty explains other ways probate can cause harm to families, not only in regards to wills, but also in regards to things like living wills. Because of this, probate should be a safety net, or final resort. The Importance of Having a Personal Estate Plan Audit Having a personal estate plan audit allows you to control where your stuff goes after you die, whether you want to donate it to charity or spread it among your family and friends. In this podcast Marty explains exactly how you can control your assets and avoid probate via this method which could end up saving you and your survivors both time and money in the long run. • Nursing Home Financial Aid: Solutions

20 MAY 2013 · Nearly a decade ago, Marty Fogarty was tired of watching families stress out over legal issues related to caring for elderly family members. This was his inspiration for founding the Heartland Law Firm www.heartlandlawfirm.com, so that families could have someone help them through the transition into the different stages of elderly life by planning ahead. In this episode of Heartland Law Firm Podcast, Marty talks with host Kimberly Henrie on the topic of nursing home financial aid. They discuss what nursing home financial aid is, who is eligible for it, and what patients must do to qualify for it. If your family member does not have long term care insurance, then living on one’s own assets can be a real strain on the family budget. Nursing Home Financial Aid Can Lower Stress Tune in to hear Marty discuss the financial anxiety that goes along with the stress of learning that a family member suffers from a chronic illness and require from some type of long-term medical care facility, such as a nursing home. Few families can pay the $7,000 to $10,000 out-of-pocket per month for a stay in such a facility. Heartland Law Firm works with families to help them qualify for a couple of different benefits, one of them being the Nursing Home Financial Aid Benefit, a subchapter of the Medicaid Laws. Here are the tests one must pass before receiving this kind of aid. 1. Asset Test – You qualify for the program if you have a certain need level, somewhat like applying for tuition assistance in college. There are different amounts for single or married, which Marty explains during the program, as well as some other stipulations. 2. Income Test – In this test, the applicant can keep $30 per month with the rest of his or her income going to the nursing home for his or her care. Financial aid pays anything over that amount to make up the difference. 3. Look-back Test – Medicaid looks at your records for the past 5 years to see what types of things might shrink someone’s estate. Marty relates that he has had clients who tried to shrink their estates through gift-giving, and that he has had to help them un-give the gifts because of it. Are you confused about elderly care law? Do you know if you fall into a category that labels you an exception to these rules? After the podcast if you have further questions, contact the Heartland Law Firm to schedule a consultation.
