  • Winning a $3 Million Verdict - The Case of John Upton

    12 MAY 2021 · On the Docket in this episode, Tina Denning takes you inside the courtroom on a case of an everyday neighborly dispute over the trimming of bushes gone awry in the affluent Encinitas, CA area that escalated and came to a chilling end with the murder of documentary filmmaker John Upton by Michael Vilkin. Vilkin, an inventor who emigrated from the former Soviet state of Georgia for the American dream, at age 63, was sentenced to 64 years in prison for Upton’s murder. Tina worked directly on the civil wrongful death and fraudulent transfer of property cases representing the victim’s children. Since the criminal prosecution has to be heard first, Tina talks about how quickly you have to move with the filing of the wrongful death lawsuit and the twists and turns a case such as this can quickly take from the fraudulent transfer of property to collecting on the verdict. The verdict resulted in a $3M award for the children, but the case highlights a flaw in the law that makes it very difficult for victims to collect after it is all said in done.   • Mark Hunt v UFC : Taking Down 1 Opponent at a Time, Part II

    26 MAR 2021 · On the docket in this episode, you will hear from the legendary Mark Hunt, heavyweight MMA fighter, aka “The Super Samoan”.  He joins the podcast in a 2-part interview.   Tina Denning, Managing Director of the premier firm Denning Moores, currently represents Mark in his lawsuit against the UFC, Dana White, and Brock Lesnar stemming from the UFC 200 in July 2016 wherein Lesnar fought Mark while on a banned performance enhancing drug.  The fight was supposed to be Lesnar's big return to the MMA.  In a fight with a lot of mystery shrouding the pre-fight drug testing of Lesnar, Lesnar was allowed to take home the bulk of the $2.5M purse. UFC’s drug testing policy at the time required fighters to spend four months in a drug testing pool before competing.  However, despite this policy, Lesnar was given a special exemption by UFC to this drug testing policy which allowed him to be ruled eligible to fight Mark. A few weeks after the fight, the world learned that Lesnar had tested positive for a banned substance not only in the in-competition test on fight night but also in a test 11 days prior to the fight.  In part II of the interview with Mark, you will learn more about the facts leading up the lawsuit and the status of it today.  In part I, you get to know the real Mark Hunt and his story of how he went from a street fight outside a bar in Auckland, New Zealand to battling his way to the top of his profession with some of the UFC, Pride, and K-1’s most memorable fights.  His story is one that begins with a terrifying early life with his siblings starving and being physically and sexually abused to one of hope and success.  Sometimes all you need is a little luck and good timing, which is how Mark’s career began in Auckland.  Mark, like most in his profession, has been taken advantage of by agents and managers that prey upon new and aspiring fighters and by the organizations that feature them, which is why he hopes that young fighters today learn from his past trials and tribulations within the sport.  He also hopes to shed more light on the prevalent doping problem within the profession and reduce its occurrences so that fights are fair and clean.  This is a no-holds-bar, not to be missed interview!

  • Kicking the Nuclear Cannister Down the Road: The San Onofre Nuclear Waste Case

    15 MAR 2021 · On the docket in this episode we are taking you inside the courtroom to hear from former US Attorney and federal prosecutor, Chuck LaBella, who is working on the high profile San Onofre nuclear waste case. He’s been on the frontlines of a very contentious and heavily litigated battle against a potential Chernobyl-level like nuclear waste crisis in San Onofre, California. In the 1960’s, The San Onofre Nuclear Generating Station (SONGS), a nuclear power plant was built in San Onofre in a tsunami zone near the coast. The plant had to be shut down and begin decommissioning in 2013 after replacement of the steam generators failed, which meant the spent nuclear waste needed to be disposed of. Yucca Mountain, Nevada had been designated as the place for the storage of spent nuclear fuel. However, during the Obama administration, Nevada objected to their facility being used for out-of-state nuclear waste, which left nuclear power plants with no place to dispose of their spent nuclear fuel and other high-level radioactive waste. The solution at San Onofre was to bury the 4000 tons of nuclear waste underground along the coastline, where it sits now. However, the cannisters that the fuel was buried are only guaranteed for a specified number of years, which is less than the life of the nuclear waste. All it takes is for a little bit of the waste to leak from the containers to trigger a major nuclear disaster. Chuck is a former US Attorney and federal prosecutor, deputy chief of the U.S. Department of Justice’s Fraud Section, where he supervised white collar crime investigations and prosecutions throughout the country. Most significantly, he was responsible for the conviction of Las Vegas Home Owners Association crime kingpin Leon Benzer, the case led to 40 other convictions. He also served as the supervising attorney of the Department of Justice Campaign Finance Task Force. The task force was charged with investigating the possible illegal infusion of Chinese foreign money and the use of ‘’soft money’’ in connection with the Clinton-Gore presidential campaign. He now works in the private sector as Of Counsel at Barnes & Thornburg focusing his practice in leading internal investigations, white collar criminal defense and representing clients in business litigation.
