David is a native of New York City, and currently, he and his wife reside in Atlanta, GA.

“If it’s told in a compelling way, it will get shared. When it’s shared, it drives conversations. When conversations are sparked about your brand, that is the key to marketing.”

“You change the perception. It’s all about companies and non-profits controlling their message, putting out their own content because in many cases a lot of these bigger companies have a massive social media following across Instagram, Facebook, and Twitter. You might have 100,000 followers on Facebook. Why aren’t you giving them great content? They’re engaged in your brand.”

“Same thing, we’re pushing out these tweets, Instagram posts, Facebook posts to drive traffic to our content, which is living on our client’s website. So, we’re driving traffic to their sites.”

Chris is President of Activate Financial, located in San Diego, which is a fully licensed, national, third-party collection agency that is focused on bad debt recovery and skip tracing services. He is an entrepreneur who has been very successful in the start-up of five new ventures over his professional career. Some of these ventures include Vital Solutions, Inc., Credit Performance Services and National Bankruptcy Services Corporation. In the interview, Chris discusses how dedication, desire, determination and hard work have been a huge part of his success.

During his extensive corporate career, Chris was the COO for American First Finance in Dallas, CEO & President of Vital Solutions, Senior Vice President of Strategic Development for Outsourcing Solutions, Inc., Senior Vice President of Business Development for JDR Receivables Management, Marketing Director and then Vice President of Business Development for Wallace & de Mayo, P.C. His career highlights include such accomplishments as delivering phenomenal growth of $80M+ in annualized revenue in less than three years for the start-up Credit Performance Services. Additionally, while at Outsourcing Solutions, Inc., he led the bad debt purchasing division and grew it from 1.8 million accounts owned in 1998 to 19 million accounts owned in 2001.

Chris earned a BS degree from the University of West Georgia and is a graduate of the Management Institute of Technology from Georgia Institute of Technology. He has served as the National Treasurer of the Chi Phi Fraternity and as Chairman of the Chi Phi Educational Trust. Furthermore, he has served as Treasurer and Vice President of the University of West Georgia’s National Alumni Association.

Chris is President of Activate Financial, located in San Diego, which is a fully licensed, national, third-party collection agency that is focused on bad debt recovery and skip tracing services. He is an entrepreneur who has been very successful in the start-up of five new ventures over his professional career. Some of these ventures include Vital Solutions, Inc., Credit Performance Services and National Bankruptcy Services Corporation. In the interview, Chris discusses how dedication, desire, determination and hard work have been a huge part of his success.

During his extensive corporate career, Chris was the COO for American First Finance in Dallas, CEO & President of Vital Solutions, Senior Vice President of Strategic Development for Outsourcing Solutions, Inc., Senior Vice President of Business Development for JDR Receivables Management, Marketing Director and then Vice President of Business Development for Wallace & de Mayo, P.C. His career highlights include such accomplishments as delivering phenomenal growth of $80M+ in annualized revenue in less than three years for the start-up Credit Performance Services. Additionally, while at Outsourcing Solutions, Inc., he led the bad debt purchasing division and grew it from 1.8 million accounts owned in 1998 to 19 million accounts owned in 2001.

Chris earned a BS degree from the University of West Georgia and is a graduate of the Management Institute of Technology from Georgia Institute of Technology. He has served as the National Treasurer of the Chi Phi Fraternity and as Chairman of the Chi Phi Educational Trust. Furthermore, he has served as Treasurer and Vice President of the University of West Georgia’s National Alumni Association.

Prior to the financial crisis, Collect America was in talks for an IPO with a valuation approaching $1.4B. After a new CEO took charge, the financial performance declined severely and SquareTwo filed bankruptcy in 2017 and was ultimately sold to Resurgent Capital Services, LP, a subsidiary of Sherman Financial Group.

In 2018, Scott and his team acquired Galaxy Capital Acquisition, LLC which is a debt buyer and master servicer located in Atlanta, GA. Additionally, Scott is an attorney at Rausch, Sturm, Israel, Enerson and Horniek, LLC, based in Wisconsin. Scott discusses how he goes back to “square one” with his new platform Galaxy.

Scott currently serves on the Board of Trustees for Valor Christian High School, the Daniels School of Business Executive Advisory Board, the Colorado UpLift Board of Directors and Executive Board and the ACE Scholarships Board of Trustees. He also served on the Denver Hospice Board of Directors and the Investment Committee.

Scott earned a BS degree in Business Administration and a JD degree from the University of Denver. In 2004, he was the recipient of the Ernst & Young Entrepreneur of the Year Award. Scott and his wife reside in Denver and are the proud parents of three daughters.

He has more than 45 years of experience developing software products, of which the last 34 years have been focused on the ARM industry. Larry founded IDA in January 2001 to purchase, underwrite, verify, and collect point of sale and bulk sub-prime indirect auto paper. He managed the growth of IDA’s portfolio to $20,000,000 and outside servicing portfolios to $90,000,000.  Larry is a recognized leader and authority in the subprime auto segment.

Prior to his achievements in the subprime auto industry, Larry spent nearly 30 years in the insurance and healthcare services industries; buying, building, operating and selling a variety of healthcare service companies in ophthalmology sectors. Larry earned a BS in Industrial Management at Georgia Institute of Technology in 1970.

Larry Pearson, President and CEO of Independent Dealers Advantage, LLC (IDA), a sub-prime automobile finance company, shares with Michael his journey from managing and owning medical providers to purchasing and servicing point of sale sub-prime in auto portfolios in the South Eastern U.S.

Larry founded IDA in January 2001 to purchase, underwrite, verify, and collect point of sale and bulk sub-prime indirect auto paper. He managed the growth of IDA’s portfolio to $20,000,000 and outside servicing portfolios to $90,000,000.  Larry is a recognized leader and authority in the subprime auto segment.

Prior to his achievements in the subprime auto industry, Larry spent nearly 30 years in the insurance and healthcare services industries; buying, building, operating and selling a variety of healthcare service companies in ophthalmology sectors. Larry earned a BS in Industrial Management at Georgia Institute of Technology in 1970.

“So he had me go to work one summer in the spinning room, cleaning lights in the cotton mill, and it was about 130 degrees … and he said … ‘You can spend the rest of your life doing this type of work or you can decide to aggressively pursue your education.’”

“Entrepreneurs would tell you they make every mistake you can possibly make along the way, and you just have to recognize your mistakes for what they are and learn from them and go on. And not let it become a failure.”

“Helping people is very important to me, my faith is very important.  I feel like I’m challenged to help people, and this was one of the ways that we could do it.”

Michael Flock interviews David Ludwig, Founder of NLEX, a company formed to promote and broker the sale of distressed assets. In their conversation, Dave shares how he developed his business, managed it through tough economic times and is now building the NLEX of the future.

Dave has taken NLEX from its start, as a post-RTC sales outlet in the 1980’s, to today, where it is the nation’s leading broker of charged-off credit card and consumer debt accounts. NLEX’s parent company conducted the industry’s first public sale of charge-offs for Bank of America in 1989. With that experience, Dave introduced selling charge-offs from financial institutions by hosting the industry’s first debt sale conference in 1994. Since then, Dave and his team have supervised sales of over 5,000 portfolios with face value of $150 billion in the US and Canada.

Dave has a Bachelor of Science Degree in Economics from the University of Illinois and has been in the financial industry for over 25 years. Considered a pioneer in the debt sales industry, he has been a featured speaker at industry conferences and quoted in numerous national media outlets.

… but most said, “No, we will never sell charge-offs. That’s a crazy idea. Why would we do this? You’re going to sell to someone that we’re going to lose control of, that’s going to violate… going to threaten to break legs and we’re going to be brought into law suits.”

… because this was before electronic media. Everything is in hard files. When we were doing a sale back then we would set up a war room of all these files, these cardboard boxes of files that people would come in and go through.

… because all we are is a relationship business. We don’t make widgets. There’s nothing we’re buying and selling. It’s a relationship business…

Mr. Bernstein founded CreditMax, LLC in 2001 and built it into one of the 25 largest debt buyers in the ARM industry by 2005 when the company generated over $60mm in revenue. In 2009, during the height of the macro-economic crisis, Mr. Bernstein made a strategic decision to exit the debt purchasing business and initiate a finance subsidiary, CMAX Finance, LLC to provide capital to underbanked, small to medium sized, debt buyers. In 2010, as part of his growth initiative for the finance business, Mr. Bernstein sold part of CreditMax to outside investors to provide additional capital for infrastructure build-out and to support a larger credit facility. Between 2009 and 2016, Mr. Bernstein originated over $350mm of loans and had his highest production year in 2016, originating over $100mm in loan volume. Mr. Bernstein sold his remaining interest in CMAX in May 2017 and subsequently formed his own company, MEB Finance Solutions LLC, which entered into an exclusive strategic alliance with Flock Specialty Finance, LLC. Mr. Bernstein’s efforts will be focused on growing Flock’s origination volume. In the first 3 months of their alliance, Flock funded over $13mm, $9mm, and $8mm, their largest 3 month funding total since Flock’s inception in 2009.

Prior to founding CreditMax, Mr. Bernstein acquired several mortgage servicing companies and portfolios in the mid to late 1990’s which he then aggregated and sold to one of the largest mortgage originators and servicers in the country. Mr. Bernstein holds a Bachelor of Science degree in finance from Georgetown University.

Lou discusses his views on his business: "We feel responsible for everything. So, if I had to say what our best feature is and what our worst feature is, it's responsibility. Sometimes it's like, "Okay just get it done." But our best client is a partner. It's somebody who we've dealt with for a long time and there's a level of trust there that we're just going to... And that's why, a little over a year ago, we started a radio show, called the Capital Club Radio Show to build a community of thought leaders, of creative people in this industry who have made a difference for the Debt Buyers Association and others in the accounts receivable management sector. We talk about lessons learned, the successes and failures of the different companies and leaders in this space, and we convert these broadcasts to podcast, which we distribute to the few thousand followers we have, and then we also distribute the podcast to our guests, and they can use the podcast as they see fit.

0:01:08.8 S2: Anyway, but this morning, I am absolutely honored to be here today, hosting the Capital Club Radio Show, as we help celebrate 20 years of the Debt Buyers Association, or DBA. We're celebrating 20 years of connections, 20 years of trust, 20 years of building a new industry. And, if you're a Falcons fan like me, maybe you're celebrating 20 years of drinking.

0:01:36.5 S2: But anyway, to be more serious, this has been an incredible roller coaster of 20 years for all of us. There have been good times and bad times, we've seen periods of great supply, we've seen periods of very tight supply. Periods of low prices and high prices. Periods of loose regulation, and periods of very onerous regulation. So we've thrived and survived in large part, thanks to the leaders of the Debt Buyers Association, some of whom are sitting right here, and also the members and staff of the total Debt Buyers Association. DBA I think has been essential to this industry. It's been essential in defining it, supporting it, and helping grow, and helping legitimize it.

0:02:25.3 S2: In our company, FLOCK Specialty Finance, we talk a lot about the power and importance of passion and perseverance, which drive performance. And I can't think of five better leaders today who represent passion, perseverance, and performance than Walt Collins, Bob Morris, Mike Bendixen, Cade Whitehurst, and Todd Lansky. And we also wanna recognize, Dennis, sitting right here, who helped start this association. He had the idea for the Debt Buyers Association along with these folks, so it was his idea that brings us here today. So Dennis, thank you very much for that idea and 20 years later we're celebrating it, it's now a reality. But without the passion and perseverance, there's no way this industry would ever have come so far from the gun-slinger culture of the past, to the more professional, more consumer friendly culture, than the debt buying and collection industry that we are today. So, I think in general the evolution of the past 20 years has been steady, but obviously not without its challenges, which we're gonna discuss here in a few minutes. And Jan Stieger shared with me some very interesting and positive statistics. According to Jan and our Executive Director who you just heard from, there were only 60 members back in 1997, and today, there are 546. In our first annual conference, there were only 125 attendees, and today, we're going to be close to 900.

0:04:08.8 S2: So in spite of the recent consolidation in our industry, due to a drop of supply of consumer charged off debt, and due to, obviously the radical regulation that we've lived through, DBA is still alive and well, and our industry is actually changing for the better in spite of this adversity, and actually maybe because of this adversity. And as I prepare for this panel discussion, and in searching for some common themes between these five leaders sitting here, and their five administrations, there was something really impressive as I began to connect the dots. Because in recent years, you know Mike, Cade, and Todd, when they were leading the organization, the focus is more on certification, compliance, standard setting. But that was actually quite similar to what Walt Collins and Bob Morris were talking about at the very inception of DBA back in 1999 and 2002. Then, you know they founded DBA to change the culture from again, the cowboy culture, to the consumer oriented culture. They took the word debtor out of the vocabulary, we now call them consumers.

0:05:23.6 S2: So today, DBS has stayed true to its initial constitution. It's focused, not just on certification and compliance, but now, how to codify the best practices, how to institutionalize things like change of title and resales, and how to bring moral liquidity to the market, how to promote standardizations, and how to recruit and create a new generation of leaders in the debt buying industry. In addition, I think that the Debt Buyers Association has become the leader in advocacy for the total accounts receivable management industry overall. In fact, Todd and Kay are probably gonna talk about what they've heard that some of the senators are actually designing legislation to legitimize and institutionalize this industry.


0:54:14.7 S2: We, we began the forum today talking about the power of community. And I think the evidence is right here at this table with these five spectacular leaders there is a great community at DBA. We're celebrating 20 years of connections. Bob shares with Michael his thoughts about the early years at Oliphant: “Well before CFPB ever became the thing, or had any impact on this business… we were misleadingly friendly in our letters, but we wanted to immediately differentiate ourselves from being any sort of an old guard agency… and I’d like to think that’s how this business actually revolutionized the ARM industry.”

Bob comments on some of the biggest changes he has seen in the debt buying industry: “the biggest thing that happened was the qualitative measurements of paper – [the] method of quantifying it and qualifying it as a purchasable asset – changed. Bank recovery managers would sell at various stages of the recovery cycle, which means you’ve got a huge price differential”

Bob Morris, CEO and founder of Oliphant Financial and co-founder of Beam software takes center stage with Michael Flock in the current episode of Capital Club Radio. Bob discusses his history in the debt buying industry as well as his view that any venture in this competitive and evolving space must be positioned for change and diversification. He shares how this philosophy has impacted the way he has managed the products and ventures he has developed over the years.

Here is a glimpse of what Bob shared in the interview.

Bob shares with Michael his thoughts about the early years at Oliphant: “Well before CFPB ever became the thing, or had any impact on this business… we were misleadingly friendly in our letters, but we wanted to immediately differentiate ourselves from being any sort of an old guard agency… and I’d like to think that’s how this business actually revolutionized the ARM industry.”

Bob comments on some of the biggest changes he has seen in the debt buying industry: “the biggest thing that happened was the qualitative measurements of paper – [the] method of quantifying it and qualifying it as a purchasable asset – changed. Bank recovery managers would sell at various stages of the recovery cycle, which means you’ve got a huge price differential”

Recently, he's transitioned from kinda the pure corporate world to one of advising. He has a company now called Fricke Consulting, and he is currently working with Morgan Stanley Private Equity on acquisitions in food services. He's also a strategic advisor to the board of a spa and wellness center company, and now also working closely with an e-commerce business platform that is entering a new vertical. Tom is a graduate of the US Naval Academy, and also obtained his MBA from Stanford University.

So with all these interesting experiences, from the Navy to corporate and now as an entrepreneur and a consultant to some start-up companies, now hear how Tom developed his philosophy of balanced leadership.

Prior to joining insideARM Tim was CEO of Integrity Solution Services, Inc.

Before that Tim was engaged in a special capacity at Academy Collection Service, Inc. (ACS) from September, 2007 through February, 2009. He was hired at ACS to facilitate a settlement of an FTC investigation of ACS that had begun in 2006 and to explore a sale of the business. The settlement was announced in July of 2008. The company was sold later that same year.

From June of 2004 through October of 2006 Tim was with Outsourcing Solutions Inc (OSI) and OSI Portfolio Services (OSIPS). During this time Tim held dual simultaneous roles. He was Executive Vice President of OSI, responsible for all sales and marketing efforts, and he was President of OSIPS, responsible for Portfolio Acquisitions.

Prior to joining OSI, Tim was Executive Vice President of Business Development at Risk Management Alternatives, Inc. (RMA) and subsequently the Chief Operating Officer. Tim was with RMA from January 1997 though February, 2004.

Before joining RMA, Tim was a Senior Vice President of the Legal Products Group for Nationwide Credit, Inc. (NCI).

Prior to joining the Agency world, Tim spent 15 years as a Shareholder with the Minneapolis law firm of Messerli & Kramer, P.A., where he was head of that firms Credit/Collections Department.

Tim was one of the founding members of the first national attorney network, the American Association of Creditor Attorneys (AACA). He was President of that organization from 1991-1992 and Vice-President from 1987-1991 and from 1992-1995.
